Terms of Service

1. Agreement to Terms

By accessing or using btqas.com and the services of BTQA Services Private Limited ("Company", "we", "us"), you agree to be bound by these Terms of Service. If you disagree, do not use our services.

2. Services

BTQAS provides software quality assurance services including but not limited to test automation, performance testing, security testing, mobile testing, and QA consulting. Specific deliverables, timelines, and fees for each engagement are defined in a separate Statement of Work (SOW) or Service Agreement.

3. Client Obligations

• Provide timely access to systems, environments, and documentation required for testing
• Ensure you have authority to authorize testing on the systems covered
• Provide accurate information about the scope and nature of services required
• Make payments as per agreed schedules

4. Intellectual Property

Upon full payment, clients receive ownership of test scripts, reports, and deliverables created specifically for their engagement. Our underlying methodologies, frameworks, and tools remain the property of BTQAS.

5. Confidentiality

Both parties agree to maintain the confidentiality of proprietary information shared during the engagement. We sign NDAs upon request and treat all client data with strict confidentiality.

6. Payment Terms

Monthly retainer fees are due within 15 days of invoice. Project-based fees follow the payment schedule in the SOW. Late payments may incur 1.5% monthly interest. We reserve the right to pause services for overdue accounts exceeding 30 days.

7. Limitation of Liability

BTQAS's liability for any claim arising from services shall not exceed the total fees paid by the client in the preceding 3 months. We are not liable for indirect, incidental, or consequential damages. QA services reduce but cannot guarantee elimination of all defects.

8. Termination

Either party may terminate a monthly engagement with 30 days written notice. We may terminate immediately for non-payment or breach of these terms. Upon termination, all outstanding fees become immediately due.

9. Governing Law

These terms are governed by the laws of India. Any disputes shall be subject to the exclusive jurisdiction of courts in Bengaluru, Karnataka, India.

10. Changes to Terms

We reserve the right to modify these terms. Material changes will be communicated via email or prominently on our website. Continued use of services after changes constitutes acceptance.
